CrossLink is a prepaid service. All internet fees are
due by the first day of each month. The fee for CrossLink services
is due on or before the first day of the billing period for which service
is provided. Credit Card Payments - Your credit card will
be charged three (3) days prior to the end of the month for the next billing
period (for example, you will be charged on January 29th for February service
if you pay monthly. Bank Direct Debit Payments - Your account will
usually be charged the first business day of the month of the next billing
period (for example, you will be charged the first business day in February
for February service if you pay monthly. Invoice Payments
- You will be invoiced the 15th of the month or the first business day
after the 15th if the 15th of the month falls on a Saturday, Sunday or
Holiday for the next billing period (for example you will be billing on
January 15th for February service if you pay monthly). If your monthly
fee for services is less than $35.00 a month you will be billed quarterly
in advance for services.
CrossLink offers a discount for annual prepayment for most services.
You must pay the annual service fee during the first month of your annual
service plan to qualify for this discount. If you do not pay during
the first month you will be charged the per month rate instead of the annual
prepaid discount rate.
Credit Card Accounts - You are responsible for notifying CrossLink
if your name, address, telephone number, the Email address you use for
correspondence, credit card number and/or credit card expiration date change.
If you fail to notify CrossLink of these changes and the credit card processing
company does not process the charge for your service, you will be sent
an Email to your last know Email address notifying you that your payment
has not been processed. If CrossLink does not hear from you within
10 days of the date your credit card charge was not accepted you will be
mailed a hard copy invoice showing the balance due CrossLink. If
CrossLink does not hear from you within one (1) month of the time your
credit card charge was not accepted you will be charged a late payment
fee equal to 1.5% per month for each month your payment is past due (or
the maximum amount allowed by law) and CrossLink may change your password
until such time your account is brought up to date. There is no re-activation
fee if your payment is received within 15 days of the time your account
password has been changed. If payment if made after the 15 day grace
period then there is a $10.00 re-activation fee for dial accounts and a
re-activation fee as specified in the contract for other services. If a
credit card payment for any service actually provided is credited then
a $25.00 processing charge or the fee specified in the contract for the
CrossLink service applies.

fail to notify CrossLink of these changes and the bank does not process
the charge for your service, you will be sent an Email to your last know

payment was not accepted you will be mailed a hard copy invoice showing
the balance due CrossLink. If CrossLink does not hear from you within

If a check for payment does not clear the bank that check will be held
in accordance with Virginia law until the full balance due CrossLink has
been received. To the extent permitted by law, the following fees
may be charged to your account as applicable. Returned check fee
– If you make a payment with a check and the check is returned unpaid,
you agree to pay a returned check fee of $25.00 for checks up to $1,000.00
($15.00 for residents of West Virginia) and $50.00 for checks over $1,000.00.
Please DO NOT INCLUDE CORRESPONDENCE WITH YOUR PAYMENT.
Notes on and with checks are not processed by the Sun Trust
lock box processing machines. Please mail all correspondence
to our qualified staff at CrossLink Billing, 5537-C Hempstead Way, Springfield,
Va. 22151.
Service Re-Activation Deposits - CrossLink reserves the right
to require a deposit before we reactivate your Service. Deposits
will appear on your bill as credits, from which we will deduct our charges.
Deposits will not earn interest.
Collection Policy and Jurisdiction - If CrossLink must use an
attorney or collection agency to collect any overdue amount from customer
and/or any guarantors, customer and each guarantor agree to pay reasonable
attorney fees and costs of collection incurred by CrossLink Internet Services,
Inc., which the parties hereby fix at fifty (50) percent of any balance
due for residential accounts and twenty-five (25) percent of any balance
due for commercial accounts, plus court costs. Customer and/or guarantor
waive privilege of being sued in their County or City of residence.
It is stipulated and agreed that the courts, general, district and circuit
of the County of Fairfax, Virginia shall be an appropriate venue for any
actions at law between the parties and especially for any actions to collect
sums alleged owing on open account by customer and/or guarantor to CrossLink
Internet Services, Inc., but this shall be non-exclusive and shall not
preclude the use of other appropriate venues pursuant to Virginia law.
This provision shall be material to any decision to extend credit to customer.
No notice of acceptance hereof need be given any guarantor. In consideration
of charges allowed and to be allowed to the customer, the guarantor hereby
personally guarantees payment of all amounts due CrossLink Internet Services,
Inc.
Assignment of Account or Agreement - We may assign your account
or this Agreement and all rights and/or obligations here under to any third
party without notice for any purpose. Including without limitation collection
of unpaid amounts, in the event of an acquisition, corporate reorganization,
merger. or sale of substantially all of the party's assets to another entity.
You hereby consent to such assignment. You must continue making all required
payments to us in accordance with your billing statement, unless otherwise
notified.

All cancellations must be in writing and RECEIVED by CrossLink
Internet via E-mail to billing@crosslink.net, US Postal Service to: CrossLink
Internet, 5537-C Hempstead Way, Springfield, VA 22151 or Fax to (703) 642-1258,
a minimum of seven (7) days PRIOR to the LAST DAY of the month you wish
the cancellation to be effective. Please see below for contact information.
Cancellations will be processed within 3 business days of receipt
of your request, and CrossLink Internet will send you written confirmation
via E-Mail or US Postal Service. You must provide a current E-mail or mailing
address for CrossLink Internet to send confirmation to. If you DO NOT receive
a written confirmation within 7-10 business days after you have made your
request to cancel then consider your service still active and you must
re-submit your request to cancel.
Accounts for which termination is requested after the seven-day
end-of-month window will be scheduled for termination effective the LAST
DAY of the following month.
In the event that your account is terminated for violation of CrossLink
Internet policies, no refund will be granted. No refunds will be given
for prepaid services (i.e., quarterly or annual accounts). If you are inadvertently
charged for services after you have received your cancellation confirmation,
then you must contact CrossLink Internet's billing department within 90
days of your cancellation date to request a refund. Any delinquent or unpaid
accounts must be paid in full before you may re-activate your account with
CrossLink Internet.
If you have signed a contract for services provided by CrossLink Internet,
the terms of the contract apply. Please reference your contract for applicable
terms and conditions.
